CRIMINAL DRAFTING -Offences relating to marriage
Any person who married again while the first marriage was subsisting commits an offence punishable under section 494 of IPC. good faith and mistake of low are no defence to a charge of bigamy. However,on court may take cognizance of an offence falling under section 493 to 496 of penal code except upon a complaint made by some person aggrieved by such offence.
Where the facts disclose both cognizable as well as non-cognizable offences concerning marriage,and complaint is not made by a person aggrieved by such offence,the police can investigate non cognizable offence also.state vrs.sharal chandra,(1996)6SCC 435.
An offence under section 494 of IPC is compoundable and the court may exercise its discretion in the matter of grnat of permission to compound the case in the larger interests.narotam vrs.state, AIR 1978 SC 1542.
